The manufacturers of a range of silicone implants, based in America, agreed to set up a global settlement scheme to provide financial compensation to anyone who could show that they had been adversely affected by the silicone implants. Alexander Harris worked closely with American lawyers who were co - coordinating the litigation so that over one hundred British women could join the group litigation in America.
Unfortunately in 1995, Dow Corning one of the manufacturers involved in the scheme filed bankruptcy proceedings in the United States. The settlement scheme collapsed while bankruptcy proceedings were finalised through the American Court System. Whilst some women received compensation payments if they received Bristol/Baxter/McGhan implants the majority of women soon began to give up hope of ever seeing a resolution to their claims.
In the summer of 2003 Alexander Harris received good news. Long negotiations between Dow Corning and American Lawyers had finally ended and a new settlement scheme called the Dow Corning Settlement Trust Facility was set up. The scheme will compensate people who have received implants manufactured by Dow Corning, Baxter, Bioplasty, Bristol, Cox-Uphoff, Mentor, Koken, Silimed, Societe Promotel or Medasil Surgical. The settlement scheme is being administered by an independent Claims Office, which is also based in America. The Claims Office aims to provide information and confidential assistance to women who now wish to settle their claims.
The effective date set by the Settlement Facility was the 1st June 2004 and all claims need to be submitted within two years of this date. To be on the safe side, all claim forms will therefore have to be submitted to the Settlement Facility before the 30th April 2006.
Due to this fast approaching deadline Alexander Harris can now only consider accepting new claimants who are already in receipt of documentary evidence of proof of manufacture for their implants.
