In June 2000, as the result of a Medicine Device Agency appointed Independent Advisory Group's findings, the Government issued advice recommending that women with Trilucent breast implants should have them removed as a precautionary measure.
The implants, which have a soya bean oil filling, were available between 1995 and 1999 and were withdrawn from sale in March 1999 due to concerns over safety.
The findings of the MDA appointed group suggested that some products that are created when the soya bean oil deteriorates, may be harmful to women with these implants. Risks of cancer and damage to an unborn baby have also not been excluded, and it has been recommended that breast-feeding and pregnancy be avoided until the implant has been removed.
It is estimated that 5,000 women through the UK received these implants. Any woman who has had these implants and wishes for them to be explanted should be made aware that firstly liability will not be an issue providing that they proceed under the compensation scheme drawn up and secondly that their legal costs will be met.
The Compensation Scheme
A protocol has been drawn up in order to deal with the compensation claims. It only covers those women who have had their Trilucent implants removed.
The claimants have been divided into two categories. The first is for those women who have had few complications with their Trilucent implants and for whom the explantation operation went smoothly with a normal recovery period. The second is for women who have suffered medical complications as a result of the implants or the explanation procedure. Currently clients are being assessed and for those which fall into the second category further investigative work is being carried out.
A deadline has been set for those people wishing to claim compensation of 5th June 2003.
