What details will I be asked for?
In order that we can thoroughly discuss your potential claim with you we will ask you for the following details, and you will be called back where possible the same day.
- Personal details
- Details of your case - details of any disabilities whether mental or physical of the main party to the case to whom you are alleging has community care needs
- The services/accommodation/equipment etc. that you may be seeking
- Financial information for funding
The team will provide you with instant advice as to the merits of your claim but may if there are complicated medical or legal issues discuss your case with Specialist Solicitors and the Head of the Mental Health and Community Care Department.
Funding Your Case
Public Funding (formerly known as Legal Aid)
In order to qualify for Legal Aid we will need you to carry out a means test which involves asking you about your finances. The area of Public Funding is complex and if an application for Public Funding is made then the full implications will be discussed with you and explained in detail.
Moving Forward
Having discussed all of the above and having assessed your case as having merits to proceeding further, funding will be applied for on your behalf. You will be given an outline of:
- How your case will proceed
- The potential difficulties or strengths in your case
- Timescales for action with regard to your case
