Natallie Evans will continue her legal challenge to save her frozen embryos from being destroyed.
Her solicitor Muiris Lyons of Alexander Harris lodged a petition for permission to appeal with the House of Lords this morning and commented: "We have today applied to the House of Lords for permission to appeal Natallie's case. We are optimistic that the petition will be granted. This will allow their Lordships the opportunity to consider the legal arguments in full. Natallie is battling to save her only chance of having a natural child of her own and understandably she wishes to pursue every possible avenue. It is important that a case of such public importance is considered by the highest court and that the law in this area is clarified."
The House of Lords will now consider the merits of the petition, which outlines the legal arguments in support of Natallie's case. It is hoped that the Court will make a decision within the next few weeks.
Notes to Editors:
On Friday the 25th of June 2004 the Court of Appeal dismissed Natallie Evans' appeal.
Natallie was granted one month from the Court of Appeal Judgment to either file a petition to the House of Lords for permission to appeal or to apply for public funding awarded by the Legal Services Commission (LSC).
An application for public funding was submitted to the LSC but to date Natallie has been unsuccessful in obtaining public funding. In the meantime, Natallie has instructed Alexander Harris to proceed and we have agreed to act for Natallie on a pro bono basis. It is hoped that if the petition is granted then Natallie's application for public funding will be reconsidered by the LSC.
