
Jane was left severely brain damaged and wheelchair-bound after a neuro-surgeon attempted to remove a brain cyst with a pair of medical tweezers.
Jane, in her late forties, was taken to hospital with a severe headache. A CT scan revealed she had a colloid cyst on the brain.
She was then admitted to the neurosurgery unit at Queen Elizabeth Hospital in Birmingham.
The cyst, which was approximately 8mm in diameter, was pressing on the brain and if not removed would have continued to increase in size.
A consultant neuro-surgeon at the hospital operated on Jane to surgically remove the cyst.
However due to negligence by the surgeon, Jane's operation -which should have been routine, went drastically wrong.
He attempted to perform a biopsy on the cyst by pulling at it with medical tweezers.
In fact, the cyst was attached to a vein and as a result caused Jane to have a large brain haemorrhage.
As a result of the surgical errors Jane is now completely paralysed on her left side, has severe memory loss, mental impairment, is partially blind and has no sense of smell.
Jane remained in Intensive Care in a coma for many months after the surgery, with a ventilator to help her breathe, and being fed through a tube.
She also had to undergo a further 11 operations.
After many rehabilitation sessions Jane is now able to sit up and speak, and has regained some movement in her right side.
The settlement has enabled the couple to move into a specially adapted bungalow and to pay for the round-the-clock care that Jane needs.
Specialist clinical negligence solicitor Claire Williams successfully settled Jane's case against the University Hospital Birmingham NHS Trust, securing compensation of over £3m. This was approved by the High Court in Birmingham.
