Rachel attended her local farm for a horse riding lesson, she had had a few lessons prior around the outdoor ménage and on led hacks but was relatively inexperienced. When on previous hacks, Rachel's horse had always been led by rope held by an experienced rider.

As part of her lesson Rachel went on another hack however the instructor chose not to have her horse on a rope. There was another inexperienced rider with Rachel and neither rider was led. Only one instructor accompanied the two riders.

Whilst on the hack, the horses bolted. The other rider's horse bolted first, causing Rachel's horse to bolt. Both riders were knocked off their horses. Fortunately the other rider fell off her horse and landed in bushes escaping with a few cuts and bruises. However, Rachel fell back onto the horse and hit her crotch on the saddle. This may have happened on a few occasions before she was eventually thrown off.

Rachel was carried back to the yard bleeding heavily from her crotch area and the horse had already made its way back rider-less. She was taken to Hospital where she spent two days recovering. Following an examination it was confirmed that she had suffered a perennial tear. Rachel continues to suffer ongoing pain, discomfort and bleeding on a daily basis and has now been referred to see a specialist.

The legal claim centres on the fact that Rachel was not an experienced rider and the conditions were inappropriate for her to be taken on a hack as it was extremely muddy and there wasn't one-to-one supervision. There is also a possibility that the saddle involved in Rachel's accident was either old or damaged in someway so as to cause her injury.
