Dave, 27, a trainee Officer Cadet at Sandhurst Royal Military Academy injured his ankle during a night training exercise.

As a result of extreme fatigue, the uneven terrain and the heavy load he was carrying, Dave fell and hurt his ankle. He sustained an inversion injury to his right ankle. Dave was later diagnosed with a stress fracture and torn ligaments. He has had to have surgical reconstruction.
Dave was discharged from the army on medical grounds. He was unable to complete his three year short service commission and his promising career in the army was cut short.

The Ministry of Defence (MOD) committed a breach of the Manual Handling Regulations by failing to make a sufficient and suitable assessment of the nature of the load and failing to provide adequate training.
